The case against the Walmart truck driver who slammed into Tracy Morgan’s limo van is going strong, as the truck driver was charged with manslaughter.

Kevin Roper, was charged on Wednesday, December 23rd, with first-degree aggravate manslaughter, second-degree vehicular homicide and eight counts of third-degree aggravated assault charges.

Roper slammed into Morgan’s limo, killing passenger James McNair and severely injuring Morgan back in June 2014. The reason behind Roper misjudgment seems to be the fact that he had allegedly been awake for more than 24 hours when his Walmart truck hit Morgan’s vehicle on the New Jersey Turnpike.

According to National Transportation Safety Board’s investigation, Roper hadn’t slept for 28 hours and failed to slow down immediately.

The 47-year old comedian and actor spent more than a year recovering from the injuries (including a serious brain injury and many broken bones) after waking from the coma. He finally returned to the stage for the first time in October, for SNL’s 30 Rock reunion.
